Employment Tribunal orders reinstatement of workers fired from Manafaru

Employment Tribunal has ordered the reinstatement of those among 29 workers fired from JA Manafaru, a resort located near HA. Hoarafushi, who have yet to secure employment elsewhere.

The 29 workers were made redundant on September 8, 2020, during the COVID-19 pandemic.

They lodged a case with the Employment Tribunal, claiming wrongful termination of employment.

On Monday, September 19, Employment Tribunal decided the dismissal of the 29 workers lacked both substantive and procedural fairness.

The Employment Tribunal ordered Manafaru to reinstate the workers, except for those whose employment contract had expired and those currently employed elsewhere.

The Employment Tribunal also declared the salary and allowances of the workers had been illegally docked.

Manafaru was ordered to pay the docked salaries and allowances to the workers within 30 working days and inform the Employment Tribunal.
