Interim order halting HDC’s repossession of Riveli Restaurant plot

The Civil Court, on Monday, issued an interim order instructing the Housing Development Corporation (HDC) against from taking any action that could obstruct the operations of Riveli Beach Club and Restaurant in Hulhumalé.

The interim order states that, until a final verdict is delivered or further directions are issued in the case concerning Riveli Beach Restaurant, operated by Solaris Hospitality Private Limited, HDC must not undertake any action that could result in the restaurant ceasing operations.

The interim order also directs HDC to reverse any measures it has already taken that may have impeded the restaurant's operations to uphold 'status quo'. 

In its interim order, the Court noted that there is a significant likelihood that Solaris Hospitality Private Limited holds a substantive legal right or legal standing warranting judicial protection under the lease agreement signed between the company and HDC.

The order further stated that, without an injunction, the "effectiveness" of the remedies sought by the parties in the ongoing proceedings could be undermined before the Court delivers its final judgment.

Notably, in an announcement on Monday, HDC said that the commercial agreement with Solaris Hospitality Private Limited for operating a business on Hulhumalé Lot No. 10877 had been terminated, and as such, the corporation has repossessed the premises, effective Monday.

According to HDC, the decision followed an extended period of unpaid rent. The corporation stated that all required notices had been issued and multiple opportunities to settle the outstanding payments had been provided in accordance with the agreement.

HDC noted that the measure was taken after the company had been granted the maximum possible flexibility. The corporation reiterated its commitment to providing favorable opportunities for businesses operating in Hulhumalé.

Located in the Ruhgandu 1 area of Hulhumalé, Riveli Beach Club and Restaurant is a popular establishment known for its scenic beachfront views. Featuring both indoor and outdoor seating, the venue was frequently used for romantic dinners and wedding receptions.
