Civil Court dismisses USD 5 million negligence lawsuit against Treetop Hospital over alleged removal of uvula

A plaintiff has failed in his attempt to seek USD 5 million in compensation from Tree Top Hospital over allegations that his uvula was cut off during a tonsil surgery.

In early 2023, a Maldivian man underwent tonsil surgery at Tree Top Hospital. After the procedure, he claimed the hospital had removed his uvula and filed a lawsuit seeking damages. In his claim, he demanded more than MVR 1 million and over USD 4 million in compensation.

According to the Civil Court’s decision, the matter falls under bodily injury caused by alleged medical negligence. The verdict was delivered Wednesday.

The judgment stated that the case could not proceed because the procedural requirements necessary for such medical negligence claims had not been fulfilled.

The case was decided by the Civil Court on Wednesday. It had been submitted to court previously as well, but the plaintiff has not been successful in any attempt to pursue the claim.
