K-Park lawsuit: Court orders MVR 1.9 mil compensation to Qasim's daughter

The Civil Court on Monday, ordered K-Park director Hassan Mamdhooh to pay back MVR 1.9 million in compensation to Jumhoory Party (JP) leader Qasim Ibrahim's daughter Khadheeja Sana.

Court ordered to pay the amount as compensation, since the developer failed to provide the purchased apartment on promised date, resulting in the claimant living on rent for the period.

The minority shareholder of K-Park, Hassan Mamdhooh faces multiple charges of fraud and misappropriation of money. Mamdhooh had fraudulently collected money from multiple potential buyers on the pretext of selling apartments.

He faces the charges as individual counts of fraud and graft.

The lawsuit filed on behalf of Sana, the claimant, said that K-Park's developer Hanbo Company failed to fulfill its promise of performance as per the contract, and failed to deliver the finished apartment on the contractually agreed date.

The claimant sought monetary compensation she incurred as rent since she did not receive the apartment on the promised date.

Civil Court on its Monday verdict held Hanbo Company was liable to pay the compensation to the claimant, which include;

  • Claimant's rent to third-parties: MVR 998,200 and USD 58,733 (MVR 905,662)
  • Legal fees: MVR 12,000

The court ordered Hanbo Company to settle the amount to the court within 30 days from the date of the verdict.

Despite awarding compensation, the court did not issue an injunction to restrict the emergence of a third-party's right for the apartment.
