The State has appealed the case of Adam Naseer Abu Bakr of H. Reendhooge, a key suspect for drug-related crimes, to High Court, following the Criminal Court finding him not guilty of any crime.
The case filed against him is for the possession of illegal drugs for the purpose of sale, and the possession of drugs without a doctor’s prescription for the purpose of sale.
Criminal Court ruled that he is found not guilty because his guilt could not be proved beyond doubt.
In the trial at High Court today, the State Lawyer Deputy Prosecutor General Hussein Shameem said that in cases such as the one at hand, what is allowed in the Constitution is reasonable proof, and thus he should be found guilty.
“We understand that his guilt has not been proven beyond doubt. However he is found reasonably guilty. We do not need to prove beyond doubt. What the Constitution states is that it must be proven to a reasonable extent,” Shameem said.
Shameem said that it was proved to the Criminal Court that the jar containing drugs found in Adam Naseer’s home in Addu, was taken home by Adam Naseer when it was found in the forest.
Shameem also said that the Criminal Court did not allow the State to present proof that the cash found on top of Adam Naseer’s wardrobes in his home in Addu and Male’, were obtained by the sale of drugs.
Today’s session ended after allowing Adam Naseer to respond to the case raised against him for the next session.
