Order to fine Police Officer for assaulting two children at Dhoonidhoo cancelled: High Court

The order by the former Criminal Court to impose a fine of Rf 4,000 on the Police Officer who forced two children out of their cells located at Dhoonidhoo, the government’s investigation prison, has been cancelled by High Court.

This incident took place in Dhoonidhoo on 30 January 2009.

The case argued against Police Officer Nishan, Adam Azmee of R. Alifushi for the assault of two children imprisoned at Dhoonidhoo, and he was found guilty of breaking the law by being involved an act which interferes with peace, and thus fined Rf 4000 by Criminal Court. This conviction was appealed against, and cancelled yesterday by High Court which looked into the case.

The sentence endorsed by High Court Judges Abdul Raoof Ibrahim, Abbas Shareef and Ali Sameer, says that Azmee holds the responsibility of custodial peace on Dhoonidhoo, and that he brought the two children out of the prison cells to follow the command of the Police Officer in charge of Dhoonidhoo custodial issues at that time.

Even though Azmee admitted to crossing the legs of one of the kids and cuffing them, it could not be proven that this act conflicts with the law.
