City Council has said that a Court Order to hand over Usfasgandu to Housing Ministry, as per Housing Ministry’s request in its case filed to Civil Court, cannot be justified.
City Council presented its defence at yesterday’s trial session.
City Council’s lawyer Mohamed Fareed said that the State’s allegations state that Usfasgandu was transferred back to the Housing Ministry subsequent to City Council’s violation of the regulations on land lease. The allegations, however, fail to explain what City Council had done in violation of the agreement made in relation to Usfasgandu.
Fareed stressed that if an asset or right is revoked due to one party having violated the agreement, it should first be proved that party had, in fact, acted in conflict with the agreement.
He said that the fact that the State’s allegations do not mention how City Council had violated the agreement proves that City Council’s actions had been in line with the agreement.
The Civil Court Judge concluded yesterday’s session after announcing that the State will be given the chance to respond to City Council’s defence, at the next session.
