State settlement to Fahmy cut down in half

High Court has cut down the settlement Civil Court ordered State to pay Mohamed Fahmy Hassan for the “unconstitutional” decision by People’s Majlis to remove him from Civil Service Commission.

Supreme Court ruled that People’s Majlis had acted unconstitutionally in voting Fahmy out of Civil Service Commission. And in reference to the Supreme Court verdict, Civil Court rule that

State needed to pay Fahmy MVR 421,733.33 in compensation.

The amount contains MVR 171,333.33 at the rate of MVR 51,400 per month in two years and six months of salary as well as compensation from the time he was removed from CSC to when he was appointed Deputy High Commissioner of Maldives to Malaysia on November 28, 2013 and started receiving his salary on December 1, 2013.

Civil Court ruled that since the basic salary of a High Commissioner was MVR 18,000 and the salary of his position in CSC was MVR 30,000, State needed to pay the difference of total MVR 250,400 at the rate of MVR 12,000 for 20 months and 26 days until Fahmy started receiving his salary as Deputy High Commissioner.

High Court, this Monday, cut the MVR 250,400 from the settlement, ruling that it cannot be proven he did not accept the position as Deputy High Commissioner and assumed the responsibilities of the position of his own free will.
