Difficulties are faced by magistrate courts in enforcing Family Law: Rozaina

Thulusdhoo MP and Dhivehi Rayyithunge Party (DRP) Women’s Group President Rozaina Adam has said that magistrate courts in islands face difficulties in obtaining the necessary assistance to enforce the Family Law.

Speaking at a press conference yesterday, Rozaina said that islands courts do not function well, which results in obstacles being faced in resolving family issues.

She said that the main difficulty for island courts is the lack of judges, which prolongs the process of providing financial assistance through court process.

In addition, courts take long periods of time to issue the report on a case after a decision is made, which denies the defendant the opportunity to appeal the case.

“Sometimes the court report is not received within 90 days, which is the period allowed to appeal the case. All these things make it very difficult for people who file cases to court,” she said.

She also noted the problem of the court prolonging the provision of money to divorced mothers and their children, after the man pays the money to the court.

“Several men have highlighted this problem, that they paid the money to court as required on the first day of each month. But the court takes one, two, three months to provide the money to the families,” she said.

DRP has commenced discussions with relevant parties to revise the Family Law.
