Moosa Anwar loses lawsuit against MNU

Moosa Anwar (Laamige, S. Hithadhoo) has lost the lawsuit against Maldives National University after Civil Court ruled that the University terminated him from the law degree offered by Faculty of Sharia and Law, in accordance with its policy.

Moosa Anwar file the lawsuit in 2014 claiming that MNU’s decision to terminate him from the course after failing twice in Islamic Legal System module was against the University’s repeat policy. And asked that the court therefore rule the University’s decision null.

Civil Court issued their verdict in the case this Sunday, in which it said that MNU’s rules read that all students needed to have an attendance of 80 percent in each module to sit in the exam.

And that documents show Moosa Anwar had been barred from sitting in exam for Islamic Legal

System module in 2011 and 2012 because he failed to meet the 80 percent attendance rate.

Court said that Moosa Anwar had said he did not take part in the exam for Islamic Legal System module in 2013 because of poor health, but gave no official document to prove the fact to MNU.

MNU said in court that though small changes had been brought and rules recompiled in 2013, no changes had been brought to its attendance policy.

And the court ruled that Moosa Anwar’s claim that he was penalized according to a policy that was set up later could not be accepted.

It ruled that there was no ground for Moosa Anwar’s claim that he was terminated from the cost in violation of MNU’s policy.
