Humaam

The appeal hearings have ended in the Humaam’s death sentence for the murder of the famous scholar Dr. Afrashim Ali.

Dr. Afrashim Ali was murdered on the night of 1 October 2012 between 11:30 p.m. and 1 a.m. while entering his residence after returning from taking part in a religious program at TVM.

At the hearing at High Court today, both sides presented their closing statements.

Humaam’s lawyer, Abdulla Haseen said that Humaam confessed in the trial at the Criminal Court after the Police threatened him. And while he has refused to the charge later, his refusal is legitimate.

The lawyer said that no evidence that proves Humaam killing anyone was not presented to court, the evidence presented by the prosecution was not enough to prove it without reasonable doubt.

Lawyer Haseen said that the verdict to Humaam’s death sentence was full of doubts and there must be no doubts in passing a verdict that has been made clear in Islam according to the Prophet Muhammad (SAW).

Judge Ali Sameer on the bench asked if Humaam has no mental issues when he was previously taken into Police custody on 29 different occasions on different crimes.

Humaan’s Lawyers said that he has those mental issues since he was a child and those escalated after he was isolated following his arrest for the murder of Dr. Afrashim.

In their closing statement, the prosecution said that Humaam’s death sentence was not only based on his confession but the witness testimonies as well.

As the verdict for the death sentence on Humaam says, the prosecutor said that after confessing to a crime that violates a right of another, they cannot retract that confession according to the leading Muslim scholars. And so after Humaam’s confession to the murder, his withdrawal cannot be accepted.

The Judges on the bench in the case was led by Judge Ali Sameer, followed by Judge Abdulla Hammed, Judge Abdul-Qani Mohamed and Judge Abdul Rauf Ibrahim and Judge Sujaau Usman
