The Judicial Service Commission (JSC) has passed to implement its decision to shuffle judges, despite the remark by the Chief Justice that this decision is ‘unlawful’.
Member appointed to JSC by the parliament, Ahmed Hamza told Sun Online that JSC received a letter on Tuesday signed by the Secretary General of the Supreme Court, stating that the Chief Justice had said that the shuffling of superior court judges was unlawful.
“It has been passed, despite the Chief Justice’s remark, that the decision should be implemented from 1 January 2014. This was passed by majority votes at today’s meeting. The Chief Justice may have said that, but that’s not a Supreme Court ruling; that’s why it was passed,” he said.
Hamza said that JSC also passed today that the decision to shuffle judges is legal.
JSC decided earlier to transfer Chief Judge of Criminal Court Abdulla Mohamed to Drug Court, Criminal Court Judge Muhthaz Fahmy to Drug Court, Chief Judge of Juvenile Court Mohamed Naeem to Drug Court, Drug Court Judge Zubair Mohamed to Criminal Court, Drug Court Judge Mohamed Eesa to Criminal Court, Family Court Judge Ibrahim Ali to Criminal Court, Drug Court Judge Abdul Sattar Abdul Hameed to Civil Court, Family Court Judge Hassan Shafeeu to Civil Court, and Criminal Court Judge Abdul Baaree Yoosuf to Juvenile Court.
