AG working against the spirit of the constitution, accuses EC

Elections Commission has said that the Attorney General’s intervention to the Jumhoory Party’s Supreme Court election case and her subsequent arguments against the interests of the Elections Commission, is against the spirit of the constitution.

In a statement published by the Elections Commission today, the Commission notes that the Attorney General’s actions, regarding the allegations of some political parties concerning the first round of the presidential polls, is in conflict of the interests of the State and the interests of the people.

Signed by the President of the Elections Commission Fuad Thaufeeq, the statement read that it is unacceptable for the Attorney General to advocate against an institution of the State while Article 133 (a) and (b) of the constitution states that the State shall be represented in all courts by the Attorney General, or by a person delegated by him.

The Commission also said expressed remorse over the Attorney General's intervention in the case, which they has fueled the baseless allegations by a political parties, in a manner that undermines the credibility of the Commission.

Speaking at the hearing of JP’s case in Supreme Court today, Attorney General Azima Shakoor said that the State is interested in neither postponing the upcoming second round of the presidential elections, nor annulling the results of the first round of polls.

However, she stressed that further information is needed from the Elections Commission to substantiate the evidence presented to court by JP.

In a separate case filed in High Court also by JP, the court has ordered the Elections Commission to allow the JP’s presidential candidate Gasim Ibrahim and his representatives to view the list of people who voted in the September 7th elections.

The Commission however, refused to allow JP to view the list today after stating that some of the Commission Members were on leave.
