Arrest of Chief Judge is in conflict with the constitution, says former Attorney General

Former Attorney General of the current regime Husnu Su’ood has said today that the arrest of Chief Judge of Criminal Court Abdulla Mohamed is made against the constitution and that he should be released immediately.

In a special interview with Sun held in his Office, Husnu Su’ood said that Abdulla Mohamed’s arrest was not made in accordance with any existing law.

“Abdulla Mohamed is under arrest. The arrest is in violation of the constitution. No citizen can be kept under arrest against the constitution. No person who works for justice will oppose this fact,” Su’ood said.

He said that the government cannot deny a person his human rights and hold him under arrest, and that nothing can be resolved by destroying the rules of the system.

“I don’t think it is an excuse to say that they want to resolve things. A person who wants to resolve things should have his hands clean, otherwise he will not be capable of resolving anything,” Su’ood said.

Su’ood who is also a renowned lawyer in the country said that the current issues can only be resolved by the Parliament. He also cited the Parliament members not carrying out their responsibilities as a reason for current unresolved issues.

“Parliament members are elected so that the public will not have to take to the streets to solve their problems. People’s representatives should solve these problems. Instead of discussing these issues during Parliament sessions, they are yelling at their party halls. The country will not be in this situation today if Parliament members fulfill their responsibilities,” Su’ood said.

He also said that the reason behind the current problems is the lack of regulations relating to the judicial system. This is a result of delays in passing the penal code and civil regulations by the Parliament. If the Parliament would work on these issues as they are supposed to, it can be completed in a short period of time.

“The regulation relating to Judges was not passed within the duration assigned for it. Neither was the regulation relating to courts,” Su’ood said.

Su’ood said that he does not believe that Abdulla Mohamed will be held under arrest much longer, and that there is no possibility of saying that his arrest was made in accordance with the constitution.

“This is the time for politicians to show their sincerity,” Su’ood said.
