The State has said that Nexbis cannot file a case to court requesting it to rule that the Parliament does not have the authority to pass a decision to order the government to terminate its agreement with Nexbis on the border control system project.
The State said this at today’s trial session on the case filed to Civil Court by Nexbis against the Parliament.
Following the State’s statement in court today, Civil Court Judge said that a decision on the procedural point raised by the government will be made along with the decision on the temporary order requested by Nexbis.
Presenting the claim in court today, lawyer representing Nexbis Ismail Visham said that the decision passed by the Parliament to order the government to terminate the agreement on the border control system project was in violation of a Supreme Court order issued on 28 November last year. Visham requested the court to thus rule the decision as void.
The State requested today to be given the opportunity to respond to the claim and the temporary order. The Judge gave the State this opportunity before concluding today’s session.
Civil Court has scheduled a session for Sunday for the State to respond to the temporary order.
Nexbis has requested for a temporary order on the State to halt implementing the Parliament’s decision until a decision is made on the case filed to court, as Nexbis may otherwise suffer irrevocable losses.
