Thoddoo MP Ali Waheed’s lawyer Husnu Su’ood has said that the Prosecutor General (PG) does not have the authority to file cases for a second time, after they are withdrawn.

He raised this procedural point in Court today, at the trial of the State’s case against Ali Waheed and Galolhu Dhekunu MP Ahmed Mahloof, which accuses them of obstructing Police duties.

Husnu Su’ood requested the Court to provide its decision on this point in writing, and said that regardless of the Court’s decision, the issue will be appealed to High Court.

The State Attorney responded by saying that the PG Office had filed cases after withdrawing them on several occasions in the past, and that he did not believe that the PG Office does not have the authority to do so.

Mahloof’s lawyer Guraidhoo MP Ibrahim Riza said while denying the charges against Mahloof, that the allegations against him were unclear.

He pointed out that about 100 people were involved in the incident, thus the accusations must be motivated by politics as charges are pressed against only two individuals.

The State Attorney responded by saying that the rest of the people involved in the incident had not been identified, and that evidence had been obtained only on Waheed and Mahloof.

Criminal Court Judge Abdullah Didi adjourned today’s session by announcing that a decision will be made on Su’ood’s procedural point at the next session.
