High Court has ruled in support of the Civil Court verdict that Yacht Tours Maldives does not need to be compensation as no irregularity was proven in Male’ City Council repossessing the site of West Park after the duration of lease agreement with Yacht Tours ended.
The appeal was filed with High Court by Yacht Tours after losing its civil lawsuit against Male’ City Council.
Yacht Tours argued that the council had violated the company’s right to extend the duration of the contract, and asked that the court order the council to rescind repossession of the land.
High Court issued its ruling in support of the original lower court ruling this Monday.
High Court ruled that there wasn’t sufficient proof Yacht Tours had negotiated with the council to extend the lease agreement made on June 30, 2005 six months prior to the end of the duration of agreement.
High Court ruled that there also wasn’t proof Yacht Tours made sufficient effort to protest or stop the council when it began the bid process to re-lease the land when the duration of the lease agreement with the company ended.
The court said there, therefore wasn’t any judicial or legal basis to support claim Male’ City Council had acted in violation of its lease agreement with Yacht Tours in not granting an extension to the lease.
The land where former Kaashidhoo MP Abdulla Jabir’s Yacht Tours’ West Part restaurant used to be run was leased out to former tennis player Amir Mansoor for 10 years in 2012.
