Court orders restitution to next-of-kin of accident victim

Juvenile Court has ordered driver of a motorcycle involved in a fatal accident in Gn. Fuvahmulah City to pay MVR 100,000 in restitution to the next-of-kin of the victim.

The accused was driving a motorcycle with another passenger at high speed from the direction of the Miskiymagu district to Dhoodigan district on Naibu Thuththu Magu of Fuvahmalah City at approximately 8:30 pm on August 3, 2013 when he crashed into another motorcycle.

Mohamed Shujau from Dhadimagu – who was driving the second motorcycle – died in hospital while receiving treatment for his injuries.

Juvenile Court ruled that Shujau had driven the motorcycle within the speed limit. And that though an eye witness testified Shujau had failed to give the signal before crossing to the other lane, it was proven to court that the accident had been a result of the accused driving beyond the speed limit and failing to pay sufficient attention to the street.

The accused also lacked a driver’s license.

Court said the full responsibility for the accident fell on the accused. And that the accident would have been avoided if he had obeyed the law.

He was ordered to pay the MVR 1,000 in restitution to Family Court within three years so that it can be sent to Shujau’s family.

He has also been ordered to fast for two consecutive months in repentance.
