High Court terminates court order to force woman back to husband’s home

High Court has terminated Dh. Kudahuvadhoo Magistrate Court order to force a woman who had moved out of her husband’s home to return back.

The court order that High Court terminated on Tuesday was issued in 2014 – after the husband pressed a lawsuit.

High Court’s order read that it was not good to issue and execute a court order to force anyone to make peace with a spouse, without one of the partners wanting to make peace.

High Court also said that Family Act provided ways to settle marital disputes. And that forcing the woman to return back to her husband’s home when she clearly does not want to would create more problems.

All three judges presiding over the case which was appealed by State voted to terminate the previous court order.
