Criminal Court has said that they cannot accept the case of President Nasheed’s transfer to prison after he was put under house arrest while serving out his 13-year prison sentence.
A statement from the Criminal Court today said that President Nasheed’s lawyer, Hisaan Hussain submitted a case to the court claiming that the former President’s transfer to prison around 9:35 p.m. last night was outside the law.
The Court said that the case cannot be accepted as per Article 60-B of the Law of Courts.
The statement said that upon reviewing the case presented by lawyer, Hisaan, it is clear that former President Nasheed is serving out a 13-year prison sentenced passed from the Criminal Court.
And country’s law of Prisons and Parole orders the Maldives Correctional Services to implement a prison sentence of someone who has been sentenced to prison.
Lawyer Hisaan submitted the case to court claiming that a letter to the former President from the Correctional Services proves that the former President was transferred to house arrest permanently while he was serving out his sentence in prison.
Commissioner of Prison, Mohamed Husham has denied those claims saying that he did not send such a letter.
