High Court supports lower court order to hand over child to mother

High Court has supported Family Court’s order to hand over the baby to her German mother Tanja Sharuan, in the case involving Tanja and her husband, the baby’s father Ahmed Sharuan of Kanmatheege, Seenu Maradhoo.

The Family Court order was appealed in High court by Ahmed.

High Court said in its ruling that considering the facts behind the order, removing the five-month old child from her mother without the mother’s consent before the Family Court makes a decision on this case, might cause the child to suffer.

The court said that it could also deny the rights of both the mother and the child, and considering the best interest of the child, it is within the jurisdiction of the Family Court to issue an order to temporarily hand over the child to the mother.
