Civil court rejects border control case

Civil court has rejected the case filed by ACC to cancel the agreement made between the Department of Immigration and Emigration and Nexbiz of Malaysia.

Civil Court Judge Ali Naseer cited the case being of the same subject matter as one submitted by ACC earlier, as a reason for rejecting the case.

As a decision has already been passed on the previous case, to investigate it further would require an appeal.

Nonetheless, when ACC first submitted the case, it was accepted by Civil Court which allowed ACC to raise their arguments, allowed the Attorney General’s Office to defend the case, as well as scheduled further hearings.

In the last hearing held for the case, Nextbiz indicated that the case cannot proceed further as it has already been looked into by the courts, with a decision issued.

When ACC raised their case, they said that even though a decision has been made regarding this case, it can be looked into provided the separate submission of a case consisting of their arguments regarding the agreement as noted in the 10th point of the hearing notes.

Vice President of ACC Muavviz Rasheed said that ACC does not have the authority to order the discontinuation of the border control system. The case will be appealed to High Court as soon as the hearing reports are received from Civil Court.
