Even Supreme Court has made decisions in conflict with the constitution: Afeef

Home Minister Hassan Afeef has said that Judges of various courts collaborate in issuing decisions on court cases, and that even the Supreme Court has made decisions which are in conflict with the constitution.

Home Minister Hassan Afeef and Defence Minister Thalhath Ibrahim Kaleyfaan were summoned to the Parliament’s National Security Committee regarding the current unrest in Male’. Afeef said that the unrest is still not under control due to the failure of the courts.

He said that the courts are responsible for releasing the activists arrested during the protests. The courts do not allow holding them in custody even for investigations.

A member asked why the cases are not appealed to higher courts when the accused are ordered to be released by the lower courts. In reply Afeef said that they are being appealed, however as the decisions are made by the Supreme Court, the only way to appeal against them is to submit the cases to the Prosecutor General’s Office.

He said that when the cases are appealed to the Prosecutor General’s Office (PG Office), the Prosecutor General attends to them as per his wishes.

Afeef said that the root cause for the current unrests in Male’ is the inefficiency of the courts, and that this results in the loss of peace in the society.
